FIRPTA Withholding Tax

Those who are foreign and want to purchase real-estate here in the United States are generally required to withhold 15% of the amount realized on the sale or disposition, unless you want to purchase through your business, then it could be much more.

FIRPTA can be a very confusing and upsetting process when Forms 8288 and 8288-A required to report, submit, and pay the IRS any tax withheld on the purchase of US real property within 20 days of the date of transfer.

FIRPTA Withholding Tax

  • We will file application to reduce withholding amount.
  • Avoiding lengthy IRS refund process by working with your realtor and the title company ensuring a favorable transition.
  • ITIN application assistance (certify documents, birth certificates, passports, etc.)
  • Tax Planning & Preparation, minimize tax and report the sale.

RFS is very much aware of the many more options that are available. One seemingly insignificant factor can drastically change the optimal path or IRS liability so make sure that your advisor listens and asks questions about your specific situation.

RFS has the experience defending our work before the IRS at the examination and appeals level and have enjoyed great success over the years.
